Earlier this year, SCOTUS barred the execution of the mentally retarded.
With all the talk of trying the 'Beltway Snipers' in Virginia because they are more likely to implement the death penalty, what do you want to bet that both John Muhammed and John Lee Malvo are suddenly diagnosed as 'mentally retarded'.
All you have to do is score poorly on an IQ test, which the federal courts have already established can be done intentionally -- then you're home free. Moreover, if you have poor grades from school, which most criminals do, that can be admitted as further evidence of your retardation.
What a wonderful ruling the Atkins case was. The courts will be sifting through the rubble of this disaster for years.
