Democrat members of the Texas Senate are violating Texas law. They fled the state to avoid arrest for violating the law. Now, with a holiday weekend approaching, they are asking a Judge to issue a restraining order to prevent police from arresting them if they return home to spend time with their families.
Of course, being liberals they probably don't even see anything wrong with the request.
correct me if I'm wrong, but wouldn't a restraining order in this case be worthless (or even illegal) in and of itself?
they would be mixing a CIVIL restraining order on a Criminal act. Therefore the police would still have the right to arrest them and the order would be null and void.
Either that or it would be a judge saying "it's okay to commit a crime."
Posted by: Jim S at August 29, 2003 3:08 PMJim, and hence: the underlying principles of such cases as Roe v. Wade which was a civil action to enjoin the prosecution of viotaions against the laws outlawing abortion. Nope, it is a correct legal measure to take.
However, I think they should be arrested and held over until the end of the weekend, and on Monday forced to do one day's hard labor on Labor Day! ;)
