Another frivolous gun lawsuit is tossed out of court like yesterday's garbage.
In a five-page opinion, [St. Louis County Judge Emmett] O'Brien wrote that such lawsuits would open "a floodgate to additional litigation." He also said that "issues of both logic and fairness" favored dismissing the case.Since we don't have a loser pays legal system, the defendants should sue for legal fees from the plaintiffs. Judges have the authority to grant legal fees in cases like this, however since most judges were former trial lawyers, it pretty much never happens.
