Virginia teacher arrested for gun in car


iconA local teacher has been arrested for leaving his handgun in his car while he was on school grounds.

A Fairfax County teacher is in trouble after police say he brought a gun onto school property. 31 year-old Timothy Fudd turned himself into police.

Investigators say an anonymous tip led school officials to search Fudd's vehicle at Westfield High in Chantilly where they say a loaded handgun was found. Fudd was released today and is now charged with possession of a weapon on school property.

Police say he has a consent to carry a concealed weapon but that does not apply on school grounds.

I'm not sure I buy this 'anonymous tip' crap, and I wonder if it was an illegal search and seizure. But I will point out that this year, the law has been relaxed so that someone with a concealed handgun permit is allowed to have a handgun secured in their vehicle on school property. While they still can't carry it around with them, simply pulling into the parking lot doesn't make you an instant felon. Sadly, for this gentleman, the change doesn't go into effect until July 1.

Yes Steve, that was my reaction as well. Too bad the law didn't go into effect until July - though I suspect that a decent lawyer will be able to get him off pretty gosh darn easily if he does have a permit.

The fact that the article mentioned he was "licensed" to have the gun suggests that may be the case, because as you know . . .. you don't normally need a license to possess a gun in Virginia. But maybe I shouldn't assume the writer knows that.

Another fine example of common sense in the legal system. In a matter of two months something goes from being wrong to right, just because, "we say so."

"anonymous tip" threw me too. Due to my case I looked into how cops can obtain "probable cause" to suspend your rights, detain you, search property, or whatever else they feel like...

Supreme court ruled the anonymous tip, saying it was ok when quite specific as to description of crime. Hopefully, it was just his wife was mad at him that morning and made the call. Then he gets off on spousal priviledge. lol

Moral of the story: keep your concealed weapon concealed. Don't tell your friends about when you do and when you don't, and SURE don't tell your enemies.

I doubt it's that simple. I'm beginning to believe that "anonymous tips" are their way of excusing away illegal searches and seizures.

You could have your gun in your car and tell nobody, but they'd still manage to find it and say they received an "anonymous tip".

The real solution is removing those laws from the books, like we did here in Virginia.
